How an Attorney Retainer Works
Attorney Retainer Fees must be pre-paid as a deposit placed in a secure legal account to be used for the expected legal services to be provided by your attorney. Once you provide your attorney with the agreed upon retainer amount, this will allow your “contracted attorney” to proceed for you with the legal services that you have agreed upon.
You must have a signed contract of Attorney work for hire between you and your attorney, BEFORE you fund the Attorney Retainer Fees. The contract describes the work the attorney agrees to do for you, the client, which also includes any additional overhead associated fees, and declares generally the agreements, expectations and rights between both parties signing the agreement.
An Attorney Retainer is requested at the beginning of your legal representation. This is when your attorney advises you that they can not accept your case and proceed, until the required retainer deposit is paid in full. Your attorney will refund to you, any remaining unused balance of your retainer, when the case is completed, after all costs and fees have been accounted for.
Sometimes, if your retainer fee is exhausted, before your case and legal services are completed, then it becomes necessary for your lawyer to ask you for an additional deposit amount, to fund your retainer, to continue working your case. See below for PayPal Pay Later option
Usually, your attorney will calculate your retainer based on their hourly rate multiplied by the hours expected to complete your case. Once your case begins your attorney will begin to subtract amounts periodically from the retainer, based on the hours worked on your case. Again be assured, any unused amount because your case does not require the entire retainer, will be returned to you. This is a legal requirement.
Your attorney will discuss with you after you initial consultation, whether a retainer is required, how it can be funded, and why it is necessary. Your advising attorney will be happy to answer any question you may have, and discuss the different funding options available to you.
